In Texas, sexual harassment prevention training is required for all state employees. Training is currently not required for the private sector. However, new state legislation about liabilities and time to report impacts all employers – both public and private.
The LawSB 45 added a new section to the Texas Labor Code:
All employers and managers can be held liable for sexual harassment they knew of, or should have known of, and failed to take immediate and corrective action. Managers/co-workers/third parties can also be held personally liable.
The time employees have to report sexual harassment claims has been increased from 1 year to 3 years.
Although Texas does not currently mandate sexual harassment training for the private sector, we offer a Texas version of our sexual harassment prevention eLearning course to educate employees and managers on this legislation.
